The non-binding referendum was illegal. Only the Congress can call a referendu, according to the Honduran Constitution, not the President. The President did anyway, in violation of the law. The President then directed the Army to distribute the ballots and they refused an illegal order. Several generals were fired or resigned over the illegal orders.

Based on that, the Honduran Congress and Supreme Court ordered the military to remove the President in accordance to the Hoduran Constitution for illegal orders that violated the Constitution.
